The most important document in a Ras Al Khaimah rental is not a WhatsApp promise, a payment receipt or a listing screenshot. It is the tenancy contract agreed by the parties and authenticated through the official process.
That distinction matters. Ras Al Khaimah’s official legislation says a lease contract or renewal must be made on the Municipality form and authenticated; an unauthenticated contract or renewal is not valid for official transactions. RAK Municipality’s current tenancy FAQ also says residential tenants must register and attest their lease annually.
This guide explains the published process and the practical checks tenants and landlords should complete before money, keys and utility responsibilities change hands. It is general guidance, not a substitute for transaction-specific legal advice.
What tenancy contract attestation does
Attestation places the rental relationship into the Municipality’s official system. RAK Municipality describes ratification of residential, commercial and investment leases as a way to preserve the rights of both lessor and lessee. Its current FAQ says registration is needed when renting for the first time, for activating electricity and water services, and for government transactions that require a valid lease.
The legal foundation is Amiri Decree No. 19 of 2021. Article 2 says lease contracts and renewals must be authenticated by the Municipality and will not be valid in official transactions without authentication.
For a tenant, the practical lesson is simple: do not treat a privately signed document as the end of the process. Ask who will submit the contract, when it will be submitted and how the authenticated copy will be delivered to both parties.
For a landlord, attestation is not administrative decoration. It creates a cleaner record of the agreed rent, term, parties and property, and helps avoid uncertainty when the contract is needed for another official procedure.
The official residential attestation fee
Amiri Decree No. 19 of 2021 sets the authentication fee at 5% of the rent stated in the contract, subject to a minimum of AED 200 for residential contracts. It sets a minimum of AED 500 for non-residential contracts.
The Decree says the lessor must collect the fee from the lessee when the contract is entered into or renewed, although the lessee may pay the fee directly to the Municipality. For a contract lasting more than one year, the Decree says the fee is collected annually at the beginning of each consecutive lease year.
RAK Municipality’s current tenancy FAQ explains an important operational change: the 5% amount is now collected in instalments through the monthly utility bill once electricity service is connected, rather than being paid entirely upfront. The FAQ also says old dues are not required as part of the new application or registration process.
Because a law and an administrative billing process answer different questions, tenants should verify the live payment schedule shown in their official application and utility account. Do not pay a duplicate “Municipality fee” to a private party without a clear invoice or confirmation of how it relates to the official charge.
How the current digital process works
RAK Municipality’s FAQ directs customers to the RAK Government digital platform at rakdigital.rak.ae and says residential, commercial and investment contract procedures can be completed digitally. A separate official service page describes online submission for a new lease, renewal or termination and says the unified lease contract is delivered by email.
The Municipality also publishes a digital guide for registered lessors. It explains that registered developers and property owners can upload units, prepare online tenancy contracts, send requests and manage approvals through the system.
The exact screen flow can change, but a sensible handover sequence is:
- Confirm the property and landlord identity before signing.
- Agree the rent, payment schedule, deposit, term and all special conditions in writing.
- Ensure the contract data matches the parties’ identification and the property record.
- Submit the contract through the official channel and keep the application or contract reference.
- Review the authenticated contract when issued rather than assuming the submitted draft was accepted unchanged.
- Confirm the utility connection and how the Municipality charge will appear in monthly billing.
Never send rent, a deposit or a fee to new bank details received only through an unexpected message. Verify the recipient and account through a trusted, previously established channel.
Documents and details to prepare
An official RAK tenancy registration service page lists the tenancy contract, title deed, Emirates IDs for the lessee and lessor, and any relevant third-party documents among the required items. The live digital service may request additional information depending on the parties or property.
Before submission, both sides should check:
- the landlord’s name or authorised lessor details;
- the tenant’s name and identification details;
- the exact unit, building and property information;
- the start and end dates;
- annual rent and cheque or payment schedule;
- security-deposit amount and receipt;
- included furniture, appliances, parking, storage and access cards;
- utility, cooling, internet and other payment responsibilities;
- maintenance responsibilities and the route for reporting defects;
- notice, renewal and early-termination wording; and
- every addendum or special condition referred to in the agreement.
If an agent or representative is acting for a landlord, ask for evidence of authority and use a licensed real estate business. A polished listing is not proof that the person presenting the property can legally receive money or bind the owner.
A tenant’s inspection before keys change hands
Contract registration does not confirm the physical condition of the home. Inspect the unit and create a dated handover record before or at move-in.
Photograph and record:
- walls, floors, doors, windows and balcony condition;
- air-conditioning operation and visible leaks;
- water pressure, hot water and drainage;
- kitchen appliances included in the lease;
- bathroom fixtures and sealant condition;
- furniture and household items in a furnished unit;
- existing marks, damage or missing items;
- parking bay, access cards, remotes and keys; and
- available meter readings or utility handover details.
Send the signed inventory or condition report through an agreed written channel and keep the response. This gives both tenant and landlord a common baseline when maintenance is reported or the deposit is considered at move-out.

Landlord checks before handover
Landlords and property managers should make the file equally clear from their side. Confirm that the unit is ready, access items are accounted for, known defects and promised works are documented, the payment schedule matches the contract, and the tenant knows where maintenance requests should go.
Keep a clean record of:
- the signed and authenticated contract;
- rent-payment evidence;
- the deposit receipt;
- the signed inventory and condition report;
- keys and access items issued;
- agreed repairs or pre-move-in works; and
- all renewal, notice and move-out correspondence.
The 2021 Decree also says the lessor must notify the Municipality within 30 days of the eviction date when a tenant leaves the unit. Landlords should use the current official cancellation or termination process and confirm that the contract and utility records are correctly closed or updated.
If the landlord does not authenticate the contract
The Decree addresses a specific failure: where the lessor has collected the authentication fee but does not submit the contract within the required period. Article 5 says the lessee may seek an order from the Rental Disputes Settlement Committee to authenticate the contract at the lessor’s expense, with the Municipality collecting the fee from the lessor.
The Municipality FAQ also states that a certified contract must be registered to be recognised by government departments and to complete legal procedures. If an attestation problem is not resolved promptly, retain the signed contract, receipts, payment evidence and correspondence, and seek guidance from RAK Municipality or an independent legal adviser. Do not rely on an online summary for a live dispute.
Five questions to answer before signing
1. Who is legally entitled to lease this unit?
Match the owner or authorised lessor information to supporting documents. Confirm an agent’s company and authority before transferring funds.
2. What is the complete first-year cash requirement?
Separate rent, deposit, agency fee, official Municipality charge, utility connection, moving and any properly disclosed building charges. Ask for invoices and receipts.
3. What exactly is included?
List furniture, appliances, parking, storage, access, maintenance commitments and any promised repairs in the contract or signed addendum.
4. Who will complete attestation, and when?
Agree the submission responsibility and obtain the authenticated contract or application reference. Confirm how the 5% Municipality fee will be billed in the specific case.
5. What happens at renewal or move-out?
Read the actual notice, renewal, early-termination, reinstatement and deposit terms. If the wording is unclear or the consequences are material, obtain independent legal advice before signing.
